PRIVACY POLICY OF AODIN EUROPE SP. Z O.O.
§1
General Provisions
  1. This document defines the rules for storing and accessing information on the User's devices using cookies for the performance of services provided by the Administrator, as well as issues related to the collection, processing and protection of personal data through the domain https://workply.net.

  2. The Service is intended to support the search for jobs by candidates or orders by industrial automation business persons. The Service is a dedicated platform for job seekers with employment contracts or civil law contracts. The intention of the Service is to increase the employability and job search assistance of candidates, and to more effectively match professionals to the needs of ongoing searches by employers and principals.

  3. We use personal data in the course of providing recruitment and selection, mediation, posting, personal development, career counseling, planning and personnel and compensation management, winning orders for programming or other mechanical engineering services (hereinafter 'Services').

  4. The Administrator shall process the Personal Data of the Data Subjects in accordance with applicable regulations, in particular Polish law and the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016 on the protection of natural persons in relation to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation, RODO).

§2
Definitions
  1. Administrator - means Aodin Europe Sp. z o.o. based in Mikołów, address: Żwirki i Wigury 65A/411A Street, 43-190 Mikołów, entered in the Register of Entrepreneurs of the National Court Register under the number 0000988564, for which the registration files are kept by the District Court Katowice -East in Katowice, VIII Economic Department of the National Court Register, NIP: 6351862859, which provides services through the Service and collects and processes User Personal Data.

  2. Cookies - means IT data, in particular text files, recorded and stored on devices through which the User uses the Service;

  3. Personal Data - any information about an identified or identifiable person means any information about an identified or identifiable natural person, an identifiable natural person is a person who can be identified directly or indirectly, in particular, name, email address, contact phone number, locality, skills, salary requirements.

  4. Account - a set of resources and settings created for the User within the Service, used to manage services.

  5. Worker Profile - means an account on the Service of an adult individual who is interested in obtaining job search assistance through the Service.

  6. Recruiter Profile - means the account of an employer or personnel consulting agency that uses the Service, having access to the database of all Workers.

  7. Partner Profile - means an account of an employer or a personnel consulting agency who use the services of the Service, having access to the database of all Workers and having the ability to create new Worker profiles and edit them.

  8. Operator of the Service - the entity that maintains and manages the Service. The Operator of the Service is Aodin Europe Sp. z o.o., based in Mikolow, address: Żwirki i Wigury 65A/411A Street, 43-190 Mikołów, entered in the Register of Entrepreneurs of the National Court Register under the number 0000988564, for which the registration files are kept by the District Court Katowice -East in Katowice, VIII Economic Department of the National Court Register, NIP: 6351862859

  9. Processing - operations or set of operations performed on Personal Data in an automated or non-automated manner, such as collecting, recording, organizing, structuring, storing, adapting or modifying, downloading, viewing.

  10. Processors - entities that process Personal Data on behalf of the Administrator.

  11. RODO - Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation).

  12. Service - the website operating at: https://workply.net

  13. Device - means the device through which the User accesses the websites of the Service;

  14. User - a natural person using the Website, in particular Worker/Recruiter/Partner .

§3
Scope and Purpose of Worker Data Collection
  1. Administrator collects Worker's Personal Data such as:

    1. Identification Data - name, city of residence, contact phone, email address;

    2. Resume/Resume - employment history, personal skills, work experience and education, and other relevant information such as photo;

    3. Salary and other benefits information - personal information regarding current salary and other benefits.

    4. other information additionally posted by the Worker on the Service.

  2. Only the Administrator has access to the Personal Information.

  3. The Administrator, after obtaining permission from the Worker, is authorized to provide the Worker's contact information (contact telephone number and e-mail address) to the Recruiter or Partner.

  4. The Worker does not have access to the Personal Data of other Workers using the Service.

  5. Worker's Personal Data is processed only for the purposes of the Administrator's Service.

  6. The Personal Data indicated in paragraph3point1 above may be obtained from the Worker directly or indirectly. In the latter case, we will inform the Worker of the purpose and sources of the data we use when we communicate with the Worker in connection with, for example, notification of employment opportunities, and in any case within one month after we indirectly obtain the Worker's data. The exception is when providing this information would cause disproportionate effort. In such a case, we may take alternative measures to protect the Worker's rights and freedoms.

  7. The Administrator reserves the right to provide the designated Worker's contact information after signing an NDA with the Recruiter and consulting with the Worker designated by the Recruiter about the possibility of cooperation.

§4
Scope and Purpose of Recruiter Data Collection
  1. The Administrator shall collect the Recruiter's Personal Data such as name, contact phone and email address.

  2. Only the Administrator has access to the Recruiter's Personal Data.

  3. The Recruiter has access to the Worker's data such as resume/resume - employment history, personal skills, work experience and education, as well as information regarding salary and other benefits, excluding Personal Data that can identify the Worker.

  4. The Recruiter, in the event that he or she wishes to contact the Worker, is required to send a request to contact the Worker designated by the Recruiter through a dedicated form. The Administrator, after obtaining permission from the Worker to share the Worker's Personal Data with the given Recruiter, will provide the Recruiter with the contact information (name, phone number and email address).

§5
Scope and Purpose of Partner Data Collection
  1. The Administrator shall collect the Partner's Personal Data such as name, contact phone number and email address.

  2. Only the Administrator has access to the Partner's Personal Data.

  3. The Partner has access to the Worker's data such as resume/resume - employment history, personal skills, work experience and education, as well as information regarding salary and other benefits, excluding Worker's Personally Identifiable Information.

  4. A Partner, in the event of a desire to contact a Worker, is required to send a request to contact the Worker designated by the Partner through a dedicated form. The Administrator, after obtaining permission from the Worker to share the Worker's Personal Data with a given Partner, will provide the Partner with the contact information (name, phone number and email address).

  5. The Partner's account allows you to create new profiles of Workers affiliated with the Partner on the basis of an employment or civil contract, containing the Worker's Personal Data, and to edit this data.

  6. Prior to Partner's creation of a Worker profile, Partner is required to obtain a statement from the Worker agreeing to the transfer and processing of his/her Personal Data by the Service Operator for purposes related to the recruitment process.

  7. In the event that a Partner creates a profile for a particular Worker, the Service Operator shall inform the Worker of the purpose and sources of the data it uses when it communicates with the Worker in connection with, for example, notification of employment opportunities, and in any case within one month of indirectly obtaining the Worker's data. The exception is when providing this information would cause disproportionate effort. In such a case, the Service Operator may take alternative measures to protect the rights and freedoms of the Worker.

§6
Legal Basis for Personal Data Processing

The legal basis for the processing of Personal Data is:

  1. the consent of the person to whom the Personal Data relates to its processing;

  2. necessity for the fulfillment of a legal obligation incumbent on the Administrator;

  3. legitimate interests pursued by the Administrator or by a third party;

Purpose of Personal Data Processing

The purpose of the processing is:

  1. 1. to contact the User who has created an account on the Service;

  2. 2. analytical and statistical activities;

  3. 3. providing the User with the opportunity to use the Service;

§8
Personal Data Processing Period

The User's Personal Data will be processed for the period necessary to carry out the purpose of processing specified above, and then for the period necessary to delete the data, no longer than 12 months from the last contact of the User with the Service Operator. This period may change at the request of the User, or as a result of the establishment of cooperation between the User and the Partner.


Notwithstanding the above, we may also store Users' Personal Data for other purposes, as long as the law allows us to continue to store it, in particular for the defense of legal claims.

§9
Voluntary Provision of Personal Data

The provision of Personal Data on the Website is voluntary, but necessary for the performance of one or more of the purposes of processing Personal Data as defined above, which the Administrator will not be able to perform if Personal Data is not provided on the Website for one or more purposes, respectively.

§10
Rights and Obligations of the Administrator
  1. The Administrator reserves the right to disclose selected Personal Data to competent authorities or third parties who make a request for such information, based on the relevant legal basis, in accordance with the provisions of applicable law.

  2. The Administrator declares that it entrusts the processing of Personal Data, on the basis of a written agreement concluded in accordance with applicable regulations, to entities providing hosting, administration, maintenance and management of the Website to the Administrator, as well as message optimization services and management of promotional campaigns.

  3. The Administrator declares that it entrusts the processing of the User's Personal Data to entities providing services to the Administrator or directly to the User to the extent necessary for the use of the Service, including the performance of contracts, , on the basis of a written agreement concluded in accordance with applicable regulations.

§11
Rights of the Data Subject

    1. to obtain information about your processed Personal Data (Article 15 of the RODO),

    2. to correct or update your Personal Data (Article 17 RODO),

    3. to delete your Personal Data (Article 17 RODO),

    4. to restrict the processing of your Personal Data (Article 18 RODO),

    5. to transfer your Personal Data (Article 20 RODO),

    6. to file a complaint with the data protection supervisory authority (Article 77 of the RODO),

    7. to revoke your consent to the processing of your Personal Data (Article 7(3) RODO),

    8. to object to certain data processing activities (Article 21 RODO).

§12
Processing of Personal Data by Processors
  1. The Processor is authorized and entitled to process Personal Data only for the purposes and to the extent specified in the Privacy Policy.

  2. Personal Data may only be processed within Poland, a European Union (EU) Member State, or a signatory to the European Economic Area (EEA) Agreement.

  3. The Processor shall process the entrusted Personal Data in accordance with applicable law, in particular the Processor:

    1. shall apply the technical and organizational measures required by law, in particular with regard to the security of the processing of Personal Data.

    2. shall apply measures to ensure: i) the ability to continuously ensure the confidentiality, integrity, availability and resilience of processing systems and services; ii) the ability to rapidly restore the availability of and access to Personal Data in the event of a physical or technical incident; iii) the regular testing, measurement and evaluation of the effectiveness of technical and organizational measures to ensure the security of processing.

    3. applies security measures for Personal Data at a level not lower than that applied by the Administrator.

  4. The Processor may change, delete or block the processed Personal Data, only at the direction of the Data Controller. If the person to whom the Personal Data pertains requests directly to the Processor to change or delete his Personal Data, the Processor shall promptly, within no more than 5 business days, forward such request to the Administrator.

  5. The Processor shall not process Personal Data for any purpose other than the performance of the obligations indicated in the Privacy Policy. The Processor shall not disclose Personal Data to third parties.

  6. The Processor shall be liable to the person to whom the Personal Data relates for damages that such person may suffer as a result of the Processor's acts and omissions.

§13
Personal Data Security
  1. The Administrator declares that it endeavors to provide the User with a high level of security with respect to the use of the Service and to this end:

    1. applies the technical and organizational measures required by law, in particular with regard to the security of the processing of Personal Data;

    2. shall apply measures to ensure: i) the ability to continuously ensure the confidentiality, integrity, availability and resilience of processing systems and services; ii) the ability to quickly restore the availability of and access to Personal Data in the event of a physical or technical incident; iii) the regular testing, measurement and evaluation of the effectiveness of technical and organizational measures to ensure the security of processing.

  2. Cookies
  1. The Service uses cookies.

  2. Cookies (so-called 'cookies') are IT data, in particular text files, which are stored in the Service User's terminal equipment and are intended for use on the Service's websites. Cookies usually contain the name of the website from which they come, the time they are stored on the end device and a unique number.

  3. The entity placing cookies on the Service User's terminal equipment and accessing them is the Service Operator.

  4. Cookies may be used for the following purposes:

    1. the creation of statistics that help to understand how the Website Users use the websites, which allows to improve their structure and content;

    2. maintaining the session of the User of the Website (after logging in), so that the User does not have to re-enter his/her login and password on each subpage of the Website;

    3. determining the User's profile in order to display customized material to the User on advertising networks, in particular the Google network;

  5. The Service uses two main types of cookies: 'session' (session cookies) and 'permanent' (persistent cookies). 'Session' cookies are temporary files that are stored on the User's terminal device until the User logs out, leaves the website or shuts down the software (web browser). 'Permanent' cookies are stored on the User's end device for the time specified in the parameters of the cookies or until they are deleted by the User.

  6. Web browsing software (Internet browser) usually allows the storage of cookies on the User's terminal device by default. Users of the Website may change their settings in this regard.   7. Restrictions on the use of cookies may affect some of the functionality available on the Website.

  8. Cookies placed on the Website User's terminal equipment and may also be used by advertisers and partners cooperating with the Website Operator.

Final Provisions

In matters not regulated in the Privacy Policy, the provisions of the law on the processing of Personal Data, including the RODO, shall apply.
